1. Overview

Welcome to SEES.

This website and online store are operated by Ebisu Oy. Throughout the site, the terms “we”, “us” and “our” refer to SEES and Ebisu Oy.

SEES is powered by Shopify, which enables us to provide the online store and related services to you.

These Terms of Service apply to your use of our website, online store, products, services, content, features and tools. By visiting, browsing, using or placing an order through our online store, you agree to these Terms of Service, our Privacy Policy, our Return Policy and any other policies referenced on our website.

Please read these Terms carefully before using our website or placing an order.

If you do not agree to these Terms, you should not use our website or online store.

3. Use of the website and customer account

You may use our website and online store only for lawful purposes and in accordance with these Terms.

To place an order or use certain features, you may be asked to provide information such as your name, email address, billing address, shipping address and payment information. You are responsible for ensuring that the information you provide is accurate, current and complete.

If you create a customer account, you are responsible for keeping your account credentials confidential and for all activity under your account.

You may not transfer, sell or assign your account to another person.

4. Products and product information

We aim to describe and display our products as accurately as possible. However, product images, colours and packaging may appear differently depending on your device, screen settings and browser.

Product descriptions, ingredients, availability, prices and packaging may change from time to time. We reserve the right to update product information, discontinue products or limit product quantities, subject to applicable law.

We make reasonable efforts to ensure that product information is accurate. If you notice an error, please contact us.

5. Orders and contract formation

When you place an order, you are making an offer to purchase the selected products.

After placing an order, you will receive an order confirmation by email. The order confirmation confirms that we have received your order.

A binding sales contract is formed when we accept your order and confirm that the order will be processed, or when the products are dispatched, depending on the order flow used in our online store.

We may decline or cancel an order only where we have a justified reason, such as product unavailability, failed payment, an obvious pricing or product information error, suspected misuse or fraud, inability to deliver to the address provided, or another lawful and justified reason.

If we cannot accept or fulfil your order, we will contact you and refund any payment already made without undue delay.

Please review your order carefully before submitting it. If you wish to cancel or change an order after placing it, please contact us as soon as possible. We cannot guarantee that changes can be made after the order has entered processing or dispatch.

You may also cancel an order before delivery in accordance with applicable consumer protection law and our Return Policy.

6. Prices, taxes and payment

Prices are shown in the currency indicated in the online store.

Prices include applicable VAT unless otherwise stated. Delivery costs and any other additional costs are shown before you complete your order.

The price charged is the price shown at the time you place your order, subject to correction of obvious errors.

We may change prices, campaigns and promotions at any time. Changes do not affect orders that have already been accepted, except in cases of obvious error.

Payments may be processed through Paytrail, Shopify Payments or other payment service providers available in the checkout. Payment service providers may have their own terms and privacy notices.

You agree to provide accurate and complete payment and billing information. We do not store full payment card details ourselves.

7. Shipping and delivery

We deliver orders using the delivery methods available in the checkout.

Delivery times shown in the online store are estimates unless expressly stated otherwise. We aim to process and deliver orders within the indicated timeframes, but delays may occur due to circumstances outside our reasonable control.

If delivery is delayed, we will inform you where required by applicable law.

Shipping costs are shown before you complete your order.

The risk of loss or damage to the products passes to the consumer when the products have been delivered to the consumer or to a person designated by the consumer. This does not limit any rights you may have under applicable consumer protection law.

Failure to collect a parcel is not considered a valid cancellation notice. If an uncollected parcel is returned to us, we may contact you to clarify whether you wish to cancel the order. Any cancellation and refund will be handled in accordance with our Return Policy and applicable law.

8. Right of withdrawal, returns and refunds

Consumers have a statutory 14-day right of withdrawal in accordance with Finnish consumer protection legislation and applicable EU rules.

The 14-day withdrawal period begins when you, or a person designated by you, have received the order. To exercise your right of withdrawal, you must inform us clearly within 14 days of receiving the order.

After notifying us of the cancellation, you must return the products without undue delay and no later than 14 days from the date on which you informed us of the cancellation.

Simply returning the product or not collecting the parcel is not considered a valid cancellation notice.

If you cancel an order or return a product that is not defective, damaged or incorrectly delivered, you are responsible for the return shipping costs. This applies where we have informed you of this responsibility before the order is placed.

We will refund payments received from you without undue delay and no later than 14 days after receiving your cancellation notice. We may withhold the refund until we have received the returned products or until you have provided proof that you have sent the products back, whichever occurs first.

Returns, cancellations, exchanges and refunds are handled in accordance with our Return Policy.

9. Non-returnable products

Some products cannot be returned after opening or use.

For hygiene and product safety reasons, opened or used cosmetics, personal care products, home care products and similar sealed products cannot be returned if the seal or packaging has been opened.

If the product has not been opened and otherwise meets the return conditions, you may cancel the purchase in accordance with the statutory right of withdrawal and our Return Policy. Sealed products that cannot be returned for health or hygiene reasons, such as moisturisers, may be excluded from the right of withdrawal after opening, but unopened products remain cancellable.

Custom-made or personalised products, gift cards and other products excluded from the statutory right of withdrawal under applicable law may also be non-returnable.

This section does not affect your statutory rights concerning defective, damaged or incorrectly delivered products.

10. Defective products and statutory rights

If a product is defective, damaged, missing or does not correspond to what was ordered, please contact us as soon as possible at customerservice@sees.fi.

We are responsible for defective products in accordance with applicable consumer protection law.

Nothing in these Terms limits your statutory rights as a consumer, including your rights concerning defective products, delayed delivery, cancellation, refunds or other mandatory consumer protection rules.

11. Promotions and discount codes

We may offer campaigns, discounts, gift cards or promotional codes from time to time.

Promotions may be subject to separate terms, such as validity period, product exclusions, minimum order value or one-time use restrictions.

If there is a conflict between these Terms and the specific terms of a promotion, the promotion terms apply to that promotion.

Discount codes cannot be exchanged for cash unless required by law.

12. Intellectual property

All content on our website and online store, including text, images, graphics, logos, product names, designs, videos, audio, layout and other materials, is owned by SEES, Ebisu Oy, our licensors or other rights holders.

You may use the website and its content for personal, non-commercial use only.

You may not copy, reproduce, distribute, modify, publish, display, transmit, sell or exploit any part of the website or its content without our prior written permission, except where permitted by applicable law.

SEES names, logos, product names, designs and slogans are trademarks or trade names of SEES, Ebisu Oy or their licensors. Shopify names and logos are trademarks of Shopify. Other names, logos and marks belong to their respective owners.

13. Third-party services and links

Our website may include links to third-party websites, services or tools. We are not responsible for the content, accuracy, availability, security or privacy practices of third-party websites or services.

If you use third-party services, you do so subject to their own terms and policies.

We may use third-party services for ecommerce functionality, payments, delivery, analytics, advertising, customer communication and other purposes.

14. Relationship with Shopify

SEES is powered by Shopify, which enables us to provide the online store to you.

However, any sales and purchases made through our online store are made directly between you and Ebisu Oy / SEES. Shopify is not the seller of the products and is not responsible for the sales contract between you and SEES, except where Shopify separately acts in another role under its own terms or applicable law.

15. Privacy

Our processing of personal information is described in our Privacy Policy.

Because our online store is powered by Shopify, certain personal information may also be processed by Shopify in accordance with Shopify’s own privacy documentation.

Please review our Privacy Policy for more information about how we, Shopify and our partners process personal information.

16. Customer feedback, reviews and user content

If you submit reviews, feedback, comments, images, suggestions or other content to us or through our website, you confirm that you have the right to submit such content and that it does not infringe the rights of any third party or violate applicable law.

You grant us the right to use, reproduce, publish, translate, modify and display such content for the purposes of operating, developing, marketing and improving our products and services.

We may moderate, remove or decline to publish user content that we consider unlawful, misleading, offensive, inappropriate, infringing or otherwise unsuitable.

You are responsible for the accuracy and legality of the content you submit.

17. Errors and inaccuracies

Occasionally, our website may contain typographical errors, inaccuracies or omissions relating to product descriptions, prices, promotions, delivery charges, delivery times or availability.

We reserve the right to correct errors and update information. If an error affects an order you have placed, we will contact you as soon as reasonably possible.

We may cancel an order affected by an obvious error where permitted by applicable law. If payment has already been made, we will refund the payment without undue delay.

18. Prohibited uses

You may not use our website or services for unlawful, fraudulent or malicious purposes, to violate applicable laws or regulations, to infringe our intellectual property rights or the rights of others, to transmit false, misleading, harmful or unlawful information, to distribute spam, malware, viruses or other harmful code, to interfere with the security or functionality of the website, to collect or track personal information of others without lawful basis, to scrape or exploit the website without permission, or to impersonate another person or misrepresent your identity.

We may restrict, suspend or terminate access to our website or customer account features if we reasonably believe that these Terms have been violated.

19. Automated access and agents

You may not use bots, scrapers, crawlers, automated agents, AI agents or other automated tools to access, copy, monitor, extract data from, interact with or otherwise use our website without our prior written permission, unless such access is permitted by applicable law or standard search engine indexing practices.

Automated access must not overload our systems, bypass security measures, misrepresent its identity or interfere with the normal operation of the website.

We may use technical measures to restrict or block automated access.

20. Availability of the website

We aim to keep our website available and functioning properly. However, we do not guarantee that the website will always be uninterrupted, error-free or available.

We may suspend, restrict or update the website for maintenance, security, technical or operational reasons.

21. Limitation of liability

Nothing in these Terms limits or excludes liability where such limitation or exclusion is not permitted by applicable law.

To the extent permitted by applicable law, we are not liable for indirect or consequential losses, loss of profit, loss of business, loss of data or other similar losses arising from your use of the website or services.

This limitation does not affect your statutory rights as a consumer, including rights relating to defective products, delayed delivery, cancellation or refunds.

22. Indemnification

If you use the website in breach of these Terms or applicable law, you may be responsible for losses, damages, liabilities and reasonable costs caused to us or third parties as a result of your breach.

This section applies only to the extent permitted by applicable law and does not limit your statutory rights as a consumer.

23. Termination

We may suspend or terminate your access to customer account features or other parts of the website if you materially breach these Terms, misuse the website or use the services unlawfully.

Termination does not affect rights or obligations that have arisen before termination.

Sections concerning intellectual property, privacy, limitation of liability, governing law and other provisions that by their nature should survive termination will continue to apply.

24. Governing law and disputes

These Terms are governed by the laws of Finland, excluding its conflict of law rules.

If you are a consumer residing in the European Union, you may also have rights under the mandatory consumer protection laws of your country of residence.

If a dispute cannot be resolved directly with us, consumers may contact the Finnish Consumer Advisory Services and, after that, bring the matter to the Finnish Consumer Disputes Board.

Nothing in these Terms limits a consumer’s right to bring a dispute before a competent court or other authority as provided by applicable law.

25. Changes to these Terms

We may update these Terms from time to time, for example to reflect changes in our services, policies, legal requirements or business operations.

The latest version of the Terms is available on our website. The “Last updated” date shows when the Terms were last revised.

Changes do not affect orders placed before the updated Terms take effect, unless required by law or expressly agreed.
